Will the retirement age remain the same in Cuba under the new Labor Code?

This is one of the questions our editorial team is most frequently asked these days: Will the retirement age remain the same in Cuba under the new Labor Code? The debate on the draft bill begins in September. The Ministry of Labor and Social Security (MTSS) confirmed earlier this month that the retirement age in Cuba will not change with the new Labor Code and the Social Security Law. Thus, the provisions of Social Security Law 105 remain in place: 60 years for women and 65 years for men.

The clarification was shared on the social network X, where the organization emphasized that the current requirements for accessing retirement remain unchanged, thus clearing up any doubts surrounding the possible reform.

However, the process of updating the Labor Code, in force since 2014, continues. Between September 8 and November 30, consultation meetings on the draft will be held throughout the country, with the participation of state and non-state workers, and collaborators on missions abroad.

The text, available in tabloid format, will be submitted for discussion so that labor groups can make their proposals for additions or modifications.

The enhanced document will then be submitted to the National Assembly of People's Power for approval.

Among the main new features of the Labor Code are:

  • Clearer regulations on teleworking and remote work, which have grown in recent years. New provisions related to hiring in the non-state sector. More specific rules for the protection of labor rights in the current economic climate.

The central objective of this process is to address the demands of the current labor market in Cuba, guaranteeing a more inclusive legal framework adapted to the transformations the country is undergoing, without altering established retirement rights.
